  5.                        PLEASE READ BEFORE USING

  8. LICENSE AGREEMENT -- USE OF THIS PRODUCT INDICATES YOUR ACCEPTANCE OF THE TERMS 
  9. AND CONDITIONS OF THIS AGREEMENT.  IF YOU DO NOT ACCEPT THEM THEN DO NOT USE THE 
  10. PRODUCT.

  12. (1).  LICENSE.  This agreement applies to any user of An Ounce Of Prevention who 
  13. has not registered with Pete Maclean.  Upon registration and payment of 
  14. appropriate fees, this license is superseded by another.
  15.  
  16. Pete Maclean grants you, pursuant to the following terms and conditions, a 
  17. fixed-term nonexclusive nontransferable license to use the software titled An 
  18. Ounce Of Prevention.  You may not modify, translate, nor disassemble the 
  19. software.  You may not sublicense the software.
  20.  
  21. (2).  WARRANTIES.  Pete Maclean warrants that it is vested with full power and 
  22. authority by the copyright holders to grant the license granted by this 
  23. agreement.

  25. THE SOFTWARE IS PROVIDED TO YOU "AS IS" WITHOUT ANY ADDITIONAL WARRANTY OF ANY 
  26. KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF 
  27. MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE.

  29. (3).  LIMITATION OF LIABILITY.  You shall not hold Pete Maclean liable for any 
  30. damages, direct, indirect, arising from any failure of this software to operate 
  31. in the manner that you or others desire.  Pete Maclean shall not be liable for 
  32. any damage to your hardware or software or to any other property that may be 
  33. caused directly or indirectly by use of the software.

  35. IN NO EVENT WILL THE MACLEAN TOOLSHOP BE LIABLE FOR ANY DAMAGES, INCLUDING ANY 
  36. LOST PROFITS, SAVINGS OR OTHER INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT 
  37. OF YOUR USE OR INABILITY TO USE THIS PROGRAM, OR FOR ANY CLAIM BY ANY OTHER 
  38. PARTY.

  40. (4).  COPYRIGHT.  This software and its related documentation are copyrighted.  
  41. The copyright holders assign you the right to reproduce and distribute the 
  42. software and documentation files provided that no modifications, additions nor 
  43. deletions of any kind are made; and provided that distribution is not done for 
  44. commercial purposes.  All other rights are reserved.

  46. An Ounce Of Prevention is a shareware product.  You are encouraged to make 
  47. copies of the product and pass them to friends, colleagues and bulletin boards 
  48. for their evaluation provided that you transfer the product in its entirety 
  49. (including all documentation files) and provided that you make no charge of any 
  50. kind.  Distribution by diskette vendors and other businesses that charge for 
  51. copies is governed by conditions set forth in the accompanying document, 
  52. VENDOR.DOC.

  54. Pete Maclean reserves the right, at any time and without notice, to withdraw 
  55. your privilege to share copies of the product.

  57. (5).  TERM & REGISTRATION.  This license is granted to you expressly and solely 
  58. to allow you to evaluate the product.  You may install and use the software on 
  59. any number of PCs of which you are the primary user.  The evaluation period 
  60. starts on the date when you first install the software and terminates when you 
  61. have determined whether or not to use the product on an ongoing basis or after 
  62. three months, whichever period is shorter.  Following this evaluation period, 
  63. you must either remove the software from all PCs on which you installed it or 
  64. register with Pete Maclean in the manner described elsewhere in the document 
  65. file called REGISTER.

  67. (6).  SEVERABILITY.  Should any term of this agreement be declared to be invalid 
  68. or illegal by any competent jurisdiction, such provision shall be severed from 
  69. this agreement and all other provisions shall remain in full force and effect.

  71. (7).  APPLICABLE LAW.  This License Agreement and Warranty shall be governed by 
  72. the laws of the State of California except as to copyright and trademark matters 
  73. which are governed by United States laws and international treaties.
